End User License Agreement
This End User License Agreement (the “Agreement”) is between you and TuttiCam (the “Developer”) concerning TuttiCam (the “Licensed Application”). This Agreement is between you and the Developer, not between you and Apple. The Developer, not Apple, is solely responsible for the Licensed Application and its content. By downloading or using the Licensed Application, you agree to this Agreement. It includes Apple’s minimum terms required for a developer’s custom license agreement.
Scope of license
The Developer grants you a limited, non-exclusive, non-transferable license to use the Licensed Application on Apple-branded devices that you own or control, in accordance with the App Store Usage Rules. Except for Family Sharing and other circumstances permitted by those rules, you may not rent, lend, sell, sublicense, or otherwise transfer the Licensed Application.
Restrictions
- You may not copy, modify, or create derivative works of the Licensed Application, except as otherwise permitted by the licenses of open-source components;
- You may not reverse engineer, decompile, disassemble, or attempt to obtain the source code of the Licensed Application, except where expressly permitted by applicable law;
- You may not circumvent, crack, or bypass paid-feature restrictions or security measures of the Licensed Application;
- You may not use the Licensed Application unlawfully, in violation of others’ rights, or in breach of this Agreement.
Permitted purpose
The Licensed Application is a tool for synchronized multi-device photography and for preparing photos and capture data for workflows such as 3D reconstruction. Content you capture with it belongs to you.
In-app purchases
Pro subscriptions and other in-app purchases are purchased through the App Store and are subject to App Store terms and the Membership Service Agreement.
Maintenance and support
The Developer is solely responsible for maintenance and support of the Licensed Application. Contact details appear at the end of this Agreement. You and the Developer acknowledge that Apple has no obligation to provide maintenance or support services for the Licensed Application.
Warranty
To the maximum extent permitted by law, the Licensed Application is provided “as is”, without any express or implied warranties. If it fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation concerning the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses arising from failure to conform to a warranty are the Developer’s responsibility under this Agreement.
Product claims
The Developer, not Apple, is responsible for addressing any claims by you or third parties relating to the Licensed Application or your possession and use of it, including, without limitation: (1) product liability claims; (2) claims that the Licensed Application fails to conform to applicable legal or regulatory requirements; and (3) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property claims
If a third party claims that the Licensed Application or your possession and use of it infringes their intellectual property rights, the Developer, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
Legal compliance
You represent and warrant that: (1) you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as “terrorist supporting”; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with export control and sanctions laws applicable in your location.
Third-party terms
You must comply with applicable third-party agreement terms when using the Licensed Application, such as terms for network services and external cameras you use.
Third-party beneficiaries
You and the Developer acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple has the right, and is deemed to have accepted that right, to enforce this Agreement against you as a third-party beneficiary.
Limitation of liability
To the maximum extent permitted by law, the Developer is not liable for indirect, incidental, special, or consequential losses arising from use of or inability to use the Licensed Application. The Developer’s total liability to you will not exceed the amount you actually paid for the Licensed Application. Any mandatory legal requirements take precedence.
Termination
This Agreement remains effective until terminated by you or the Developer. Your rights automatically terminate if you fail to comply with any term of this Agreement, and you must stop using and delete the Licensed Application. Provisions concerning restrictions, warranty, limitation of liability, and similar matters survive termination.
Governing law
This Agreement is governed by the laws of the People’s Republic of China (excluding Hong Kong, Macao, and Taiwan for the purposes of this Agreement). If this Agreement conflicts with the Terms of Service, this Agreement takes precedence on matters concerning the license to use the Licensed Application.
